Privacy Notice

Night Off is operated by Todd Creek Capital, LLC (“Night Off,” “we,” “us,” or “our”). This Privacy Notice explains how we collect, use, disclose, retain, and protect personal information when you use the Night Off parent app, sitter app, websites, text-message features, support channels, and related services (together, the “Service”).

This Notice applies to parents, family members, sitters, people invited to use Night Off, and website visitors. Our Terms of Service explain additional rules for using the Service.

If someone invites you before you have an account, we may receive your name and phone number from that person and use them to create and deliver the invitation, prevent duplicate or excessive sends, and connect your account if you later accept.

When a parent uses the optional device-contact picker, the current design transfers only the contact selected by the parent and the selected contact's display name and phone number. Night Off does not need the parent's entire address book for this feature.

Booking, availability, and coordination information

We collect information users submit or generate while coordinating, including:

Notes may be included in coordination texts to connected users. Please enter only information reasonably needed for the arrangement. Do not place medical records, financial credentials, school records, Social Security numbers, door or alarm codes, or other highly sensitive information in free-text fields.

Membership and transaction information

Family membership payments are processed by Stripe. Stripe collects payment-card and billing information through its hosted checkout and billing portal. Night Off does not directly store complete payment-card numbers.

Support information

If you contact support, we receive the information you choose to provide and the contact information used to reach us. Internal product-support records are designed to use a short redacted summary, app/build and operating-system details, issue category and severity, status, assigned owner, and resolution evidence without copying phone numbers, email addresses, child names, credentials, payment details, or raw messages into the internal ticket summary.

Limited measurement and attribution information

If Night Off enables its first-party measurement feature, we may collect a limited set of campaign and product-event information after providing any required notice or choice. This may include:

The designed measurement records do not contain names, phone numbers, child information, booking times, notes, message bodies, or contact lists. Pending campaign information may be held temporarily in local storage before an authenticated account connection. Night Off does not use third-party advertising networks or sell measurement data.

Technical information

Our apps, hosting providers, security tools, and service providers may generate technical information needed to operate and secure the Service, such as IP address, request time, device or browser type, app version, operating system, error details, and server or security logs.

We disclose personal information only as described below.

Connected families and sitters

We display or transmit information to users involved in a connection or arrangement. For example, connected users may receive names, phone numbers, family labels, dates, times, availability, booking status, rates, payment handles, and notes. A parent may share family records with a co-parent or other family member. We do not provide public user profiles or public sitter search.

People you invite

We use and disclose the sender's identity, family name, invitation information, and limited coordination details as needed to deliver an invitation or request to the intended recipient.

Service providers

We use providers that process information for us to operate the Service, including:

These providers receive information relevant to the service they perform and may also process information under their own terms and privacy notices.

We do not share mobile information with third parties or affiliates for their marketing or promotional purposes. We do not share text-message opt-in data or consent with third parties for their own marketing. This limitation does not prevent us from using providers and carriers that transmit the messages, or from making a disclosure required by law.

Legal, safety, and business purposes

We may disclose information if we reasonably believe disclosure is required by law or legal process, or is reasonably necessary to protect users, minors, Night Off, the public, or the security and integrity of the Service.

If Todd Creek Capital, LLC or Night Off is involved in a merger, financing, reorganization, bankruptcy, sale of assets, or transfer of the Service, information may be reviewed or transferred as part of that transaction, subject to confidentiality and applicable law.

Text messages

Ongoing coordination texts are optional. You may change your preference in the app or reply STOP to a Night Off text. Reply HELP for help. A text already submitted to a carrier may still arrive. If a carrier-level STOP remains active, selecting text messages in the app may not resume delivery until you reply START.

Night Off may still send a one-time passcode or another message reasonably necessary to verify or secure your account, subject to applicable law.

Account and profile information

You may update certain family, sitter, list, contact, rate, payment-handle, and availability information in the app. You may remove connections or decline invitations. Another user may retain their own relationship and booking records as described below.

If optional measurement is enabled, Night Off will provide the notice and controls approved for that feature before production collection.

6. Account deletion and retention

You may initiate account deletion inside either Night Off app. Before deleting, directly resolve or communicate about upcoming arrangements; deletion does not notify other users.

Other families may retain contact information they saved for you, marked as removed, and their own booking and message history. Stripe, Twilio, telecommunications carriers, and other providers may retain transaction, message, security, or legal records under their own policies. Some information may remain for a limited time in backups, fraud/security records, support evidence, financial records, or other records we reasonably need to comply with law, resolve disputes, enforce agreements, or protect users and the Service.

We otherwise retain information while your account or a relevant family/connection remains active and for as long as reasonably necessary for the purposes described in this Notice. Retention depends on the type of record, whether another user controls a shared record, billing and chargeback needs, safety/security needs, and legal obligations.

If deletion cannot safely complete—for example, because billing status cannot be reconciled—the Service may pause deletion and ask you to retry or contact support rather than partially deleting the account.

7. Privacy requests

You may email wade@toddcreekcapital.com to ask about, access, correct, or delete personal information associated with you, or to appeal a prior privacy-request decision. We may need to verify your phone number, account, authority, or identity before acting. We may deny or limit a request where permitted by law, including to protect another person's information or preserve required records.

Depending on where you live and which laws apply to Night Off, you may have additional privacy rights. We will handle verified requests as required by applicable law.

8. Children and teen sitters

Parent accounts are for adults. Sitter accounts are intended for people age 13 or older. A sitter under 18 may use the Service only with a parent or legal guardian's permission. The Service is not intended for children under 13, and children under 13 may not create accounts.

Parents may enter a child's name, nickname, bedtime indicator, or limited coordination note. That does not create an account for the child. Parents should provide only the information reasonably necessary for the arrangement and should avoid sensitive child information in free-text fields.

If you believe a child under 13 created an account or directly provided personal information through the Service, contact wade@toddcreekcapital.com so we can review and take appropriate action.

9. Security

We use administrative, technical, and organizational measures designed to protect personal information. These include phone verification, access controls, database row-level restrictions, service-only operational records, message opt-out checks, and limited internal support/measurement schemas. No security measure, device, carrier, network, or storage system is completely secure.

You are responsible for securing your phone and promptly reporting suspected unauthorized access.

10. United States operation

Night Off is operated from the United States and currently supports US phone numbers. Information may be processed in locations where our service providers operate.

11. Changes to this Notice

We may update this Notice to reflect changes in the Service, our practices, or applicable requirements. The effective date appears at the top. If a change materially affects how we use personal information, we will provide notice through the Service, at the phone number associated with the account, or by another reasonable method before or when the change takes effect, as appropriate.
