Effective: September 16, 2026
Night Off is operated by Todd Creek Capital, LLC, a Nebraska limited liability company (“Night Off,” “we,” “us,” or “our”). This Privacy Notice explains how we collect, use, disclose, retain, and protect personal information when you use the Night Off parent app, sitter app, website (nightoffapp.com), waitlist, text-message features, support channels, and related services (together, the “Service”).
This Notice applies to parents, family members, sitters, people invited to use Night Off, waitlist members, and website visitors. Our Terms of Service explain additional rules for using the Service.
The information we collect depends on how you use Night Off.
We collect:
We use phone numbers to identify accounts and send one-time passcodes. If you use both parent and sitter experiences, the same login may connect to both roles.
Parents and sitters may provide:
If someone invites you before you have an account, we may receive your name and phone number from that person and use them to create and deliver the invitation, prevent duplicate or excessive sends, and connect your account if you later accept.
When a parent uses the optional device-contact picker, only the contact the parent selects (display name and phone number) is transferred. Night Off does not access the parent's entire address book.
We collect information users submit or generate while coordinating, including:
Notes may be included in coordination texts to connected users. Please enter only information reasonably needed for the arrangement. Do not place medical records, financial credentials, school records, Social Security numbers, door or alarm codes, or other highly sensitive information in free-text fields.
If text messaging is used, we may process:
Messages sent through carriers may also be processed under the carrier's and Twilio's own terms and privacy practices.
Family membership payments are processed by Stripe. Stripe collects payment-card and billing information through its hosted checkout and billing portal. Night Off does not directly store complete payment-card numbers.
Night Off receives and stores information needed to manage membership, such as:
For eligible Android membership purchases, Stripe collects the billing address in its hosted checkout. We may receive billing-address information in Stripe's transaction records and retain the tax country and, where required for tax reporting, state or administrative area. We also keep the transaction amounts, tax, currency, time and purchase, renewal and refund identifiers needed to manage membership and meet the external-link program's reporting obligations. Night Off does not receive complete payment-card numbers through this integration.
We also keep fresh Google Play purchase-link tokens and hashes used to prevent token reuse.
If you join the Night Off waitlist on nightoffapp.com, we collect your name, email address, the role you select (parent or sitter), and your phone number if you choose to give one. We use this only to send you one notice when the Night Off apps are available — by email, or by text if you asked for a text — and to avoid duplicate sign-ups. We do not use it for other marketing or share it with third parties for their marketing. The waitlist is stored with Cloudflare, our website host. To be removed, email wade@toddcreekcapital.com.
If you contact support, we receive the information you choose to provide and the contact information used to reach us. We keep internal support records to a short summary and technical details and avoid copying phone numbers, email addresses, child names, credentials, payment details, or message contents into them.
Night Off may measure how people find and use the Service using its own first-party records, such as a pseudonymous attribution key, campaign and channel values, and events such as account signup, a sitter accepting a connection, a sitter posting availability or responding to a request, a first, second, or fifth confirmed booking, membership start, membership cancellation, and refund. These records do not contain names, phone numbers, child information, booking times, notes, message contents, or contact lists. Campaign information may be held briefly on your device before you sign in. Night Off does not use third-party advertising networks for this and does not sell or share measurement data for cross-context behavioral advertising.
Our apps, website, hosting providers, and security tools automatically generate technical information needed to operate and secure the Service, such as IP address, request time, device or browser type, app version, operating system, error details, and server or security logs. Our website does not use advertising or cross-site tracking cookies.
We use personal information to:
We disclose personal information only as described below.
We display or transmit information to users involved in a connection or arrangement. For example, connected users may receive names, phone numbers, family labels, dates, times, availability, booking status, rates, payment handles, bios, and notes. A parent may share family records with a co-parent or other family member. We do not provide public user profiles or public sitter search.
We use and disclose the sender's identity, family name, invitation information, and limited coordination details as needed to deliver an invitation or request to the intended recipient.
We use providers that process information for us to operate the Service, including:
These providers receive information relevant to the service they perform and may also process information under their own terms and privacy notices.
We do not share mobile information with third parties or affiliates for their marketing or promotional purposes. Text-message opt-in data and consent are not shared with any third party, except with the providers and carriers that deliver the messages or where required by law.
When an Android membership transaction uses Google's external content links program, we report required transaction and tax information to Google, including amounts, currency, transaction time, tax country and any required administrative area, and transaction tokens or identifiers linking the purchase, renewals and refunds. Google processes these reports under its applicable program terms and privacy practices.
We may disclose information if we believe in good faith that disclosure is required by law or legal process, or is reasonably necessary to protect the safety of any person (including a minor), to investigate fraud or abuse, or to protect the rights, property, or security of Night Off, our users, or the public.
If Todd Creek Capital, LLC or Night Off is involved in a merger, financing, reorganization, bankruptcy, sale of assets, or transfer of the Service, information may be reviewed or transferred as part of that transaction, subject to confidentiality and applicable law. Any successor will be bound by this Notice for the information transferred.
Because we do not sell or share personal information for targeted advertising, there is nothing to opt out of. We treat a Global Privacy Control signal as a request not to sell or share.
Ongoing coordination texts are optional. You may change your preference in the app or reply STOP to a Night Off text. Reply HELP for help. A text already submitted to a carrier may still arrive. If a carrier-level STOP remains active, selecting text messages in the app may not resume delivery until you reply START.
Night Off may still send a one-time passcode or another message reasonably necessary to verify or secure your account, subject to applicable law.
You may update certain family, sitter, list, contact, rate, payment-handle, and availability information in the app. You may remove connections or decline invitations. Another user may retain their own relationship and booking records as described below.
Email wade@toddcreekcapital.com to be removed from the waitlist at any time.
You may delete your account inside either Night Off app, or by emailing wade@toddcreekcapital.com. Before deleting, directly resolve or communicate about upcoming arrangements; deletion does not notify other users.
Account deletion is intended to:
Other families may retain contact information they saved for you, marked as removed, and their own booking and message history. Stripe, Twilio, carriers, and other providers may retain transaction, message, security, or legal records under their own policies. Some information may remain for a limited time in backups until they expire in the normal cycle, and we may keep records we reasonably need for fraud prevention, security, financial and tax records, text-message consent records, dispute resolution, enforcement of our agreements, or legal compliance.
We retain the minimum external-link transaction, tax, reconciliation and security records needed for reporting, refunds, disputes and compliance, including after account deletion where necessary. We protect purchase-link tokens and clear token contents after successful initial reporting or verified abandonment; unresolved or completed transaction cases may require longer retention. We may retain token hashes to prevent reuse. Cleanup depends on reconciliation and the reporting system's operation, not a fixed deletion period for every attempt.
Otherwise, we keep information while your account or a relevant family or connection remains active, and afterward only as long as reasonably necessary for the purposes described in this Notice. Waitlist information is deleted after the launch notice is sent, or when you ask us to remove it.
If deletion cannot safely complete—for example, because billing status cannot be reconciled—the Service may pause deletion and ask you to retry or contact support rather than partially deleting the account.
You may email wade@toddcreekcapital.com to ask what personal information we hold about you, to get a copy, to correct it, or to delete it, or to appeal a decision we made about a prior request. We will respond within 45 days, or within the time applicable law requires. We may need to verify your phone number, account, or identity before acting, and you may use an authorized agent where the law allows, with proof of authorization. We may deny or limit a request where permitted by law, for example to protect another person's information or preserve records we are required to keep. We will not discriminate against you for exercising your privacy rights.
Depending on where you live, you may have additional rights under state privacy laws. We will honor those rights as applicable law requires. If we deny your request, you may appeal by replying to our decision. If your appeal is denied, you may contact your state attorney general.
Parent accounts are for adults 18 and older. Sitter accounts are for people 13 and older. A sitter under 18 may use the Service only with a parent or legal guardian's permission. The Service is not directed to children under 13, and children under 13 may not create accounts. We do not knowingly collect personal information directly from children under 13.
Parents may enter a child's name, nickname, bedtime indicator, or limited coordination note. That does not create an account for the child. Parents should provide only the information reasonably necessary for the arrangement and should avoid sensitive child information in free-text fields.
We do not sell the personal information of sitters under 18 or use it for targeted advertising. A parent or guardian of a sitter under 18 may contact wade@toddcreekcapital.com to review or delete that sitter's information.
If you believe a child under 13 created an account or provided personal information through the Service, contact wade@toddcreekcapital.com and we will delete it.
We use administrative, technical, and organizational measures designed to protect personal information, including phone verification, access controls, database row-level restrictions, and limited internal records. No security measure, device, carrier, network, or storage system is completely secure. If we learn of a security breach affecting your personal information, we will notify you as required by law.
You are responsible for securing your phone and promptly reporting suspected unauthorized access.
Night Off is operated from the United States, is intended for users in the United States, and currently supports US phone numbers. Information is processed and stored in the United States and in other locations where our service providers operate.
We may update this Notice to reflect changes in the Service, our practices, or applicable requirements. The effective date appears at the top. If a change materially affects how we use personal information, we will provide notice through the Service, at the phone number associated with the account, or by another reasonable method before the change takes effect.
